Terms of service

Version 1.0
1. Who we are and what these terms cover
notabot is provided by its operator (“we”, “us”). These terms govern your use of the notabot website, dashboard and API (together, the “Service”). By creating an account or using an API key you accept them. They are the whole agreement between you and us about the Service.
2. Definitions
- API key: the secret credential that authenticates your requests.
- Credits: prepaid euro balance consumed by successful requests.
- Documentation: the usage guides published at /docs.
- Force majeure: events outside our reasonable control, including outages of internet, cloud, hosting or payment providers, cyberattacks, failures of third-party systems the Service relies on, government action, strikes, natural disasters and epidemics.
3. Your account
You sign in with Discord. You must be at least 16 years old and give accurate information. One account per person: we may refuse or close duplicate accounts and accounts linked to fraud. You are responsible for everything done with your account and API keys. Keep keys secret, rotate or revoke them from the dashboard if exposed, and tell us immediately through the contact page if you suspect misuse.
4. Licence
Subject to these terms and to having credits, we grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable right to use the Service. You may integrate the API into your own software. You may not resell, sublicense or redistribute access to the API or your keys, or offer the Service to third parties as your own, without our written agreement.
5. Acceptable use
You must use the Service only for lawful purposes and in line with the Documentation. In particular you must not:
- use it for fraud, account takeover, credential stuffing, unauthorised access to systems or data, or any activity that breaks the law or harms third parties;
- copy, modify, reverse-engineer or attempt to extract the source code or internal logic of the Service;
- circumvent rate limits, spend limits, metering or other protections of the Service, or interfere with our monitoring;
- overload, disrupt or degrade the Service or its infrastructure;
- infringe intellectual property rights or remove proprietary notices.
You are solely responsible for how you use the results of the Service and for complying with the terms of the websites you interact with. We monitor usage to keep the Service reliable and to detect abuse.
6. Credits, prices and payment
- The Service is pay-as-you-go: you buy credits in advance by card through Stripe, in euros. There is no subscription and nothing renews automatically.
- Each successful request consumes credits at the price shown on the site for its product type. Failed or timed-out requests are not charged.
- Volume bonuses (“levels”) are added as extra credits when you buy, based on your lifetime confirmed purchases.
- Credits do not expire while your account is open. They have no cash value, are not money, are non-refundable, and cannot be transferred, sold or exchanged (see the Refund policy). Credits are forfeited if your account is closed for breach of these terms.
- We may change prices with notice on the site. Price changes apply to requests made after the change; credits already bought keep their euro value.
- We may refuse a payment or order where we suspect fraud or a breach of these terms.
7. Refunds and right of withdrawal
Credits are prepaid and non-refundable, and all sales are final, as set out in the Refund policy. Credits are delivered immediately after purchase. By purchasing, you ask us to begin providing the Service straight away and you accept that you lose any statutory 14-day right of withdrawal as soon as the credits are made available. This does not affect any refund that mandatory consumer law requires.
8. Chargebacks
If you open a payment dispute or chargeback, we remove the credits from that purchase, suspend the account and its API keys while we review the case, and may close the account. If the dispute is resolved in your favour by mistake, contact us first. We would rather fix it directly.
9. Service availability and changes
The Service is provided “as is” and “as available”. We work to keep it fast and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that any particular request will succeed. Third-party websites change their protections without notice, so the success rate of a product type can vary. We may modify, suspend or discontinue a product type or feature, with notice when reasonably possible.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately if you breach these terms, create a risk for us or other users, or if required by law. Closing an account does not give a right to a refund; credits are non-refundable and any credits remaining on closure are forfeited, as set out in the Refund policy.
11. Intellectual property
We and our licensors own all rights in the Service, the API, the website, the Documentation and the notabot brand. You receive only the rights expressly granted in section 4. Open-source components remain under their own licences.
12. Liability
- Our total liability under or in connection with the Service is limited to the lower of (a) the amounts you paid us in the three months before the event giving rise to the claim, or (b) €1,000.
- We are not liable for indirect or consequential loss, including lost profit, revenue, business, goodwill, data, or missed purchases, or for downtime of the Service.
- We are not liable for failures caused by force majeure.
- These limits do not apply to wilful misconduct or gross negligence, or where the law does not allow them, in particular towards consumers.
- Please notify us in writing of any claim promptly and give us a reasonable period, at least 30 days, to remedy it before considering us in breach.
13. Indemnity
You will indemnify us against third-party claims, losses and costs arising from your breach of these terms, your misuse of the Service, or your unlawful conduct.
14. Changes to these terms
We may update these terms. We will publish the new version on this page and, for material changes, notify you by Discord or email at least 14 days before they take effect. If you do not agree, stop using the Service before that date; credits already purchased remain non-refundable.
15. General
If a provision is held invalid, the rest stays in force and the invalid provision is replaced by a valid one as close as possible to its purpose. Our not enforcing a right is not a waiver.
16. Governing law and disputes
These terms are governed by French law. Before any legal action, contact us through the contact page so we can try to resolve the issue amicably. Consumers keep the mandatory protections of their country of residence and may use a consumer mediator or the EU online dispute resolution platform. Otherwise, the courts of the place of our registered office have jurisdiction.
